PRIVACY POLICY

1. GENERAL CONDITIONS

1.1. The personal information provided by the Users of the Feel by Cubanas Online Store is stored in computers and Cubanas is responsible for its respective handling, and the filing number with the National Commission for Data Protection is 6527/2014, without prejudice to the terms set forth in Item 2.3 above. Cubanas observes and applies all necessary and appropriate procedures and protocols with respect to the REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 (hereinafter referred to as “REPC”).

1.2. Personal information means any information concerning an identified or identifiable individual (an individual is deemed to be identifiable when one can be identified, directly or indirectly, especially by reference to an identifying element).

1.3. Any individual that, as a Buyer, logs in to the Feel by Cubanas Online Store, whether or not buying or selling some of the Products available or to be made available, is deemed to be a “User”, hereinafter referred to as User.

1.4. The User’s information (name, surname, shipping address) is required to place an Order through the Feel by Cubanas Online Store and that is why it is requested while logging in. The taxpayer number is optional.

1.5. The information gathered while logging in to the Feel by Cubanas Online Store is used solely for processing and handling Orders and will not be transmitted to third parties, except to the Suppliers that will be supplying one or more Products and only to the extent needed in order to issue the corresponding invoice and deliver or return the Products. All appropriate measures shall be taken to comply with data protection rules.

1.6. The Buyers authorize the said information to be provided to the Suppliers.

1.7. The User’s e-mail address is only used for informing the Order status or providing information on the products/services that are or will be made available by Feel by Cubanas, according to express authorization for such given by the User under item 2.7 above.

1.8. The information is located in a password-protected (access code) area in the Feel by Cubanas Online Store chosen by the User him/herself while logging in and to which the User is the only one who have access.

1.9. When logging in to the Feel by Cubanas Online Store, the User gives or does not give his/her consent to Cubanas so that it can send “unsolicited communications”, as set forth in Article 8 of Decree-Law No. 24/2014 of February 14.

2.The User’s personal information is retained by Cubanas only for the period of time necessary for the aforementioned purposes, except when there are legal obligations according to the applicable law (such as tax or commercial law) requiring that your personal information is retained for a longer period.

2.1. The information entered for payment purposes are duly protected and encrypted by cutting-edge and the most efficient security tools, namely the Security Certificate SSL, which is Hipay’s responsibility.

3. ACCESS TO GATHERED DATA

3.1. The User is expressly granted, at any time, free of charge and restrictions, access to his/her information as well as its respective deletion or rectification under the terms set forth in the applicable law through the password provided for access while logging in.

4. GATHER DATA HANDLING

4.1. When logging in to the Feel by Cubanas Online Store the User authorizes its personal information to be gathered, handled and transmitted under the terms and for the effects aforementioned, including to Countries outside the European Economic Area.

4.2. Cubanas does not handle personal information that discloses the individual’s race or ethnicity, political opinions, religious or philosophical beliefs and union association, or genetic-, health- or sexual-related information.

4.3. Cubanas is the entity responsible for gathering and handling personal information and it can be reached through the email address support@cubanas-shoes.com

5. GATHERED DATA UPDATE

5.1. The Buyers assure and are responsible for the accuracy, correctness and authenticity of the information they provide to Feel by Cubanas and undertake to keep it duly updated until its profile is deleted in the Feel by Cubanas Online Store. The Feel by Cubanas Online Store is required to update and/or rectify such information when requested by the Buyers.

6. BUYER’S LOGIN CANCELATION

6.1. The User’s personal information is retained by Cubanas only for the period of time necessary for the aforementioned purposes, except when there are legal obligations according to the applicable law (such as tax or commercial law) requiring that your personal information is retained for a longer period. Without prejudice to the information set forth in the previous Item, Cubanas undertakes to delete all personal information it possesses on a certain Buyer whenever such Buyer cancels its login in the Feel by Cubanas Online Store.

6.2. Cubanas assures that it will treat the User’s personal information as confidential and only according to for the purposes aforementioned, and it will not use or treat any User’s Personal Information for any other purpose other than to supply the Products.

6.3. Cubanas shall take reasonable measures to assure that all employees and subcontractors that take part in handling Personal Information are reliable.

6.4. Cubanas shall take reasonable measures to assure that all Suppliers are reliable and that they follow and comply with all applicable rules and take all measures and adopt all procedures necessary to comply with and follow REPC.

6.5. In the event the User’s Personal Information is to be transferred outside the EEA, an agreement shall be promptly entered into by the respective parties (or, in case of transfer by or to a subcontractor, by said subcontractor and the other respective party) and it shall contain appropriate EU-type Clauses or the equivalent.

7. COMMUNICATION

7.1. In accordance with REPC, the Customer or User may contact Cubanas in case of any questions about the Privacy Policy or to change, correct or delete his/her personal information, at any time, by means of a written request to Cubanas sent to the following email address: support@cubanas-shoes.com

8. PRIVACY POLICY AND E GENERAL TERMS OF USE

8.1. This “Privacy Policy” is an integral part of the “General Terms of Use” of Feel by Cubanas Online Store and it shall be read, reviewed, understood, and construed always in accordance and together with the terms and conditions set forth in such document and other supplementary documents thereto duly identified herein.

9. ACRONYMS

9.1. According to the previous Clause, the words contained in this “Privacy Policy” that start with a capital letter have the same meaning as that assigned to them in the “General Terms of Use” of Feel by Cubanas Online Store, unless as otherwise stated herein.
